Licensed Application End User License Agreement
Acknowledgement: You and RepSetGo acknowledge that this EULA is concluded between you and RepSetGo, Inc. only, and not with Apple, and RepSetGo, Inc., not Apple, is solely responsible for the Licensed Application and the content thereof. This EULA does not provide for usage rules for Licensed Applications that are in conflict with the Apple Media Services Terms and Conditions.
RepSetGo (the "Licensed Application") is licensed, not sold, to you. Your license to the Licensed Application is subject to your acceptance of this End User License Agreement ("EULA"). The Application Provider (RepSetGo, Inc.) reserves all rights in and to the Licensed Application not expressly granted to you under this EULA.
Scope of License
The license granted to you for the Licensed Application is limited to a non-transferable license to use the Licensed Application on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that such Licensed Application may be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing.
You may not distribute or make the Licensed Application available over a network where it could be used by multiple devices at the same time. You may not transfer, redistribute or sublicense the Licensed Application and, if you sell your Apple Device to a third party, you must remove the Licensed Application from the Apple Device before doing so.
You may not copy (except as permitted by this license), reverse-engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the Licensed Application, any updates, or any part thereof (except as and only to the extent that any foregoing restriction is prohibited by applicable law).
Maintenance and Support
RepSetGo, Inc. is solely responsible for providing any maintenance and support services with respect to the Licensed Application, as specified in this EULA, or as required under applicable law. You and RepSetGo acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application.
Warranty
RepSetGo, Inc. is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Licensed Application to you; and that, to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be RepSetGo's sole responsibility.
Product Claims
You and RepSetGo acknowledge that RepSetGo, Inc., not Apple, is responsible for addressing any claims of yours or any third party relating to the Licensed Application or your possession and/or use of that Licensed Application, including, but not limited to: (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation, including in connection with the Licensed Application's use of the HealthKit and HomeKit frameworks. This EULA does not limit RepSetGo's liability to you beyond what is permitted by applicable law.
Intellectual Property Rights
You and RepSetGo acknowledge that, in the event of any third party claim that the Licensed Application or your possession and use of that Licensed Application infringes that third party's intellectual property rights, RepSetGo, Inc., not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.
Legal Compliance
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

Third Party Terms of Agreement
You must comply with applicable third party terms of agreement when using the Licensed Application, including but not limited to your wireless data service agreement when using the Application.
Third Party Beneficiary
You and RepSetGo acknowledge and agree that Apple, and Apple's subsidiaries, are third party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third party beneficiary thereof.
General Terms and Conditions
The following terms and conditions apply to your use of the RepSetGo mobile application and related services, including any content, functionality and services offered on or via the RepSetGo app and website.
Please read these Terms and Conditions carefully before you start using RepSetGo, because by using the Application you accept and agree to be bound and abide by these Terms and Conditions.
These Terms and Conditions are effective as of January 1, 2025. We expressly reserve the right to change these Terms and Conditions from time to time without notice to you. You acknowledge and agree that it is your responsibility to review this Application and these Terms and Conditions from time to time and to familiarize yourself with any modifications. Your continued use of this Application after such modifications will constitute acknowledgement of the modified Terms and Conditions and agreement to abide and be bound by the modified Terms and Conditions.
The RepSetGo application and related services are owned and operated by RepSetGo, Inc.
Conduct on Application
Your use of the Application is subject to all applicable laws and regulations, and you are solely responsible for the substance of your communications through the Application.
By posting information in or otherwise using any communications service, social features, or other interactive service that may be available to you on or through this Application, you agree that you will not upload, share, post, or otherwise distribute or facilitate distribution of any content — including text, communications, software, images, sounds, data, or other information — that:
- Is unlawful, threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, invasive of another's privacy, tortious, contains explicit or graphic descriptions or accounts of sexual acts, or otherwise violates our rules or policies
- Victimizes, harasses, degrades, or intimidates an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability
- Infringes on any patent, trademark, trade secret, copyright, right of publicity, or other proprietary right of any party
- Constitutes unauthorized or unsolicited advertising, junk or bulk communications, chain letters, any other form of unauthorized solicitation, or any form of lottery or gambling
- Contains software viruses or any other computer code, files, or programs that are designed or intended to disrupt, damage, or limit the functioning of any software, hardware, or telecommunications equipment or to damage or obtain unauthorized access to any data or other information of any third party
- Impersonates any person or entity, including any of our employees or representatives
We neither endorse nor assume any liability for the contents of any material uploaded or submitted by users of the Application. We generally do not pre-screen, monitor, or edit the content posted by users of communications services or other interactive services that may be available on or through this Application.
However, we and our agents have the right at their sole discretion to remove any content that, in our judgment, does not comply with these Terms of Use and any other rules of user conduct for our Application, or is otherwise harmful, objectionable, or inaccurate. We are not responsible for any failure or delay in removing such content.
Health and Fitness Disclaimer
RepSetGo is designed to help you track your fitness activities and provide AI-powered coaching suggestions. However, the Application is not intended to provide medical advice, diagnosis, or treatment. You should consult with a healthcare professional before beginning any fitness program or making significant changes to your exercise routine.
The AI coaching features (FLEX) provide general fitness guidance based on your input data and should not replace professional medical or fitness advice. You use the fitness recommendations at your own risk.
Apple Health Integration
RepSetGo integrates with Apple Health and HealthKit to sync your fitness data. By enabling this integration, you consent to the sharing of your health and fitness data between RepSetGo and Apple Health. You can disable this integration at any time through your device settings.
Intellectual Property
By accepting these Terms and Conditions, you acknowledge and agree that all content presented to you on this Application is protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws, and is the sole property of RepSetGo, Inc.
You are only permitted to use the content as expressly authorized by us or the specific content provider. Except for a single copy made for personal use only, you may not copy, reproduce, modify, republish, upload, post, transmit, or distribute any documents or information from this Application in any form or by any means without prior written permission from us.
Third Party Services
This Application may integrate with or link you to other services on the Internet, including Apple Health, exercise databases, and other fitness-related services. These services may contain information or material that some people may find inappropriate or offensive.
These other services and parties are not under our control, and you acknowledge that we are not responsible for the accuracy, copyright compliance, legality, decency, or any other aspect of the content of such services. The inclusion of such integration or link is provided merely as a convenience and does not imply endorsement of, or association with, the service or party by us.
Consent to Use of Data
You agree that RepSetGo may collect and use technical data and related information—including but not limited to technical information about your device, system and application software, and peripherals—that is gathered periodically to facilitate the provision of software updates, product support, and other services to you related to the Licensed Application. RepSetGo may use this information, as long as it is in a form that does not personally identify you, to improve its products or to provide services or technologies to you.
External Services
The Licensed Application may enable access to RepSetGo's and/or third-party services and websites (collectively and individually, "External Services"). You agree to use the External Services at your sole risk. RepSetGo is not responsible for examining or evaluating the content or accuracy of any third-party External Services, and shall not be liable for any such third-party External Services. Data displayed by any Licensed Application or External Service, including but not limited to fitness, health and location information, is for general informational purposes only and is not guaranteed by RepSetGo or its agents.
NO WARRANTY
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE LICENSED APPLICATION IS AT YOUR SOLE RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE LICENSED APPLICATION AND ANY SERVICES PERFORMED OR PROVIDED BY THE LICENSED APPLICATION ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, AND REPSETGO HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE LICENSED APPLICATION AND ANY SERVICES, EITHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES AND/OR CONDITIONS OF MERCHANTABILITY, OF SATISFACTORY QUALITY, OF FITNESS FOR A PARTICULAR PURPOSE, OF ACCURACY, OF QUIET ENJOYMENT, AND OF NONINFRINGEMENT OF THIRD-PARTY RIGHTS.
NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY REPSETGO OR ITS AUTHORIZED REPRESENTATIVE SHALL CREATE A WARRANTY. SHOULD THE LICENSED APPLICATION OR SERVICES PROVE DEFECTIVE, YOU ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR, OR CORRECTION. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR LIMITATIONS ON APPLICABLE STATUTORY RIGHTS OF A CONSUMER, SO THE ABOVE EXCLUSION AND LIMITATIONS MAY NOT APPLY TO YOU.
Limitation of Liability
TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL REPSETGO BE LIABLE FOR PERSONAL INJURY OR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE LICENSED APPLICATION, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, OR OTHERWISE) AND EVEN IF REPSETGO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF LIABILITY FOR PERSONAL INJURY, OR OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THIS LIMITATION MAY NOT APPLY TO YOU. In no event shall RepSetGo's total liability to you for all damages (other than as may be required by applicable law in cases involving personal injury) exceed the amount of fifty dollars ($50.00). The foregoing limitations will apply even if the above stated remedy fails of its essential purpose.
Export Control
You may not use or otherwise export or re-export the Licensed Application except as authorized by United States law and the laws of the jurisdiction in which the Licensed Application was obtained. In particular, but without limitation, the Licensed Application may not be exported or re-export (a) into any U.S.-embargoed countries or (b) to anyone on the U.S. Treasury Department's Specially Designated Nationals List or the U.S. Department of Commerce Denied Persons List or Entity List.
Additional Terms for iOS Apps
Your use of RepSetGo is at your sole risk. The Application is provided "as is" and "as available". We disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement.
You acknowledge that you have only a limited, non-exclusive, nontransferable license to use the Application. Because the Application is not error or bug free, you agree that you will use it carefully and avoid using it in ways which might result in any loss of your or any third party's property or information.
Subscription and Payment Terms
RepSetGo may offer premium features through subscription plans. All subscription fees are non-refundable except as required by applicable law. Subscriptions will automatically renew unless cancelled at least 24 hours before the end of the current period.
You can manage and cancel your subscription through your Apple App Store account settings.
Data Privacy
Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Application, to understand our practices regarding the collection and use of your personal information.
Term and Termination
These Terms and Conditions will become effective in relation to you when you create a RepSetGo account or when you start using RepSetGo and will remain effective until terminated by you or by us.
RepSetGo reserves the right to terminate these Terms and Conditions or suspend your account at any time in case of unauthorized, or suspected unauthorized use of the Application whether in contravention of these Terms and Conditions or otherwise. If RepSetGo terminates these Terms and Conditions, or suspends your account for any of the reasons set out in this section, RepSetGo shall have no liability or responsibility to you.
Assignment
RepSetGo may assign these Terms and Conditions or any part of it without restrictions. You may not assign these Terms and Conditions or any part of it to any third party.
Governing Law
These Terms and Conditions and any dispute or claim arising out of, or related to them, shall be governed by and construed in accordance with the laws of the United States without giving effect to any choice or conflict of law provision or rule.
Any legal suit, action or proceeding arising out of, or related to, these Terms of Service or the Application shall be instituted exclusively in the federal courts of the United States.
